Terms & Conditions

Any student caught employing unfair practice during before and after any course, is subject to immediate expulsion from the course and no refund of the fee already paid shall be made at any cost. A student after qualifying and taking admission at any centre of Bombay School of Make-up or Bombay School of Make-up & Hair (BSMH) will be bound by the rules & regulation of that centre and in all matters whatsoever the responsibility will be of that centre only. Note: Any type of scholarship/concession/discount given to the students may attract Service Tax/ GST to be paid by the students/parents if levied by the Govt. or as per law at any point of time will be charged/recovered from the student/parents.

While enrolling in any course of BSMH through the medium of online enrolment process or in person, you (the students) are deemed to have accepted the terms and conditions listed below. reserves the right to add, delete, alter or modify these terms and conditions carefully at any point of time. The User is therefore advised to read these terms and conditions every time he/she uses the BSMH Online Enrolment Service(s) of BSMH. All products/services and information displayed on BSMH website constitute an "invitation to offer". Your order for purchase constitutes your "offer" which shall be subject to the terms and conditions given below. BSMH reserves the right to accept or reject your offer.

The agreement between you and the BSMH shall be subject to the following terms and conditions:-

The User certifies that he/she is at least 15 (eighteen) years of age or has the consent of a parent or legal guardian.
These terms and conditions supersede all previous representations, understandings, or agreements and shall prevail notwithstanding any variance with any other terms of any order submitted. By enrolling for any courses of BSMH (physical or online) you agree to be bound by the Terms and Conditions.
All prices, unless indicated specially are in Indian Rupees.
All prices and availability of products are subject to change without prior notice at the sole discretion of BSMH.
BSMH reserves the right to refuse or cancel any enrolment to any course, which is listed at an incorrect price. This shall be regardless of whether the order has been confirmed or the payment has been levied via credit card/NEFT/Cheque. In the event, the payment has been processed by BSMH, the same shall be credited to your credit card account and duly notified to you through email, call, whatsapp and/or SMS.
In a credit card transaction, you must use your own credit card. BSMH will not be liable for any credit card fraud. The liability to use a card fraudulently and the onus to prove otherwise shall be exclusively on the user.
Any request for cancellations of orders once duly placed on the site or in person, shall not be entertained and no refund shall be initiated for the same.
BSMH shall not be liable for any delay of commencement of courses than the dates mentioned on the website in case of act of God such as flood, fire, wars, or any cause that is beyond the control of BSMH.
The User agrees to use the services provided by BSMH through their website www.bombay-school-of-makeup.com and www.bombaysm.com for lawful purposes only.
The User agrees to provide authentic and true information. BSMH reserves the right to confirm and validate the information and other details provided by the User at any point of time. If upon confirmation such User details are found to be flawed/incorrect (wholly or partly), BSMH has the right in its sole discretion to reject the registration and debar the User from attending any of its courses without prior intimation whatsoever. In such a case any fees paid by the user shall be forfeited and the student will not have any right to demand refund.
BSMH will not be responsible for any damage suffered by users from attending any courses of BSMH. This without limitation includes loss of revenue, damage to health due to use of any product used during training sessions or otherwise, any medical issue whether temporary or permanent in nature due to any accident during training, any physical or mental damage due to action of trainer or fellow students or staff of BSMH. This disclaimer of liability also applies to any damages or injury caused by any failure of performance, error, omission, interruption, deletion, defect, delay in operation or transmission, computer virus, communication line failure, theft or destruction or unauthorized access to, alteration of, or use of record, whether for breach of contract, tortuous behaviour, negligence, or under any other cause of action.
The User agrees clearly that the use of BSMH services is at the Users sole risk. BSMH affiliates, employees, agents, consultants, contracted companies make no warranties of any kind, whether expressed or implied for the service it is providing or as to the results that may be obtained from the use of the Service, or as to the accuracy, reliability or content of any information, service, or merchandise provided through this Service. It is also clearly understood that all warranties, implied or expressed take place between the vendors and the User.
BSMH users/students must upload their self-attested photocopy of their Identity proof (Aadhar card/Passport/Driving license) and recent passport size color photographs along with dully filled Enromment/Registration/Admission Form (online form available on www.bombay-school-of-makeup.com).
Any student enrolled with BSMH will have to regularly work hard. In case the teacher feel that the student is not working hard, creating indiscipline or using unfair means in the institute or bus, irregular in attendance, not responding properly, he/she may be expelled from the school. The decision of the Centre In charge in this regard will be final and binding on the student/parent. No fee or part of the fee will be refunded in such cases.
If any student absents himself/herself for more than 2 days continuously without any prior written application, he/she will not be allowed to attend/join the classes and will not be given any shoots, materials, test paper(s), he/she may be deemed to be expelled from the school. No separate intimation will be sent to the parents. No fee or part of the fee paid/encashed will be refunded in such cases. The decision of the Center Head in this regard will be final and binding on the students & parents.
After depositing money towards ‘Registration & Admission’, if a student becomes disinterested in the school due to any reason whatsoever and wants to take his/her money back, the School will not refund the money deposited towards Registration fee/Admission fee. The registration/admission fee deposited towards a particular course will not be adjusted against any other course.
If any student/parent insists on lump sum payment of fee, the School can accept the same. The refund policy for such students will be same as students, who would pay the fee in installments.
Incomplete form will be rejected. It is compulsory to attach photocopy of Identity Card (Aadhar card / Passport / PAN) and affix a recent passport size colour photograph along with the admission form.
The parents can meet the Centre-In-charge for any enquiry about their ward’s progress or any other problem concerning their ward with prior appointment only.
Any study material given during the classes or otherwise, will not be given to those students, who are absent without prior application from the parents. No request/personal appointments in this regard shall be entertained.
It is the responsibility of the parents to submit the fee of their ward in time as per schedule given in the prospectus. They should not expect reminders and calls from the centre.
In case, cheques are submitted and get bounced then a penalty of INR 500 + GST and a late fee of `50 per day shall be charged on the fee amount due. However, fee will be accepted with late fee only up to the end of the month failing which the name of student will be struck off.
If the cheque is bounced for any reason whatsoever, a fine of INR 500 + GST will be charged separately from the student along with the fee installment. This amount will be charged in cash only.
It is compulsory/mandatory to provide active e-mail I.D. Mobile No and whatsapp No. of the student/ father/guardian. The result of tests, important notifications, updates and/or any other information of the Institute will be sent to the student through email, call, whatsapp and/or SMS. The Institute shall not be responsible for any information regarding result or anything else not received by the student if he/she has not given his/her e-mail I.D./mobile no. in the Admission form at the time of admission.
If any type of mishap occurs in the premises of BSMH because of situations beyond control or any natural calamity such as earthquake, floods, fire, electric short circuit etc, the institute/school/academy shall not be responsible in any manner whatsoever.
Students are not allowed to use mobile phones for calls or text messages during class. If any student continues to use the same even after providing 3 warnings, it will be treated as misconduct, and the center incharge has the right to concel their admission. The School is not responsible for any loss/theft of mobile phone in the Institute.
The Institute shall not be responsible for providing seating arrangement to the parents while the classes of their wards are in progress. As we don’t have any waiting area at front office parents are requested to make their own arrangements.
School / Institute reserves the right to use the photograph for publicity in case the student secures position/success in any work even after completion of the course.
Any change in the correspondence address or phone number should be intimated to Registered Office immediately through a written application quoting the Name, Reference ID, and Roll No. of the student.
The entry into the classes is permitted only with the valid Identity Card issued to each and every student. If any student is found misusing the I-Card, he/she will be rusticated from the Institute.
In case any parent/guardian/student is found misbehaving with any staff member of the Institute, his/her ward can be rusticated and no claim to retain such student will be entertained. The decision of the Center Head / Director will be final and binding on the student and parents/guardian.
Registered Students can obtain duplicate I-Card from the Institute against the proof of registration along with payment of INR150/-.
Once the name of a student is struck-off due to the non-payment of fee for more than 2 weeks from the due date, the student shall have to pay INR5000/- for re-admission.
If at any point of time, the Govt. further increases service tax, the extra amount of service tax will be borne by the students from the date of enforcement of the act by the Govt.
BSMH reserves the right to make any alteration in its programs/venue/timing and days of classes without any prior notice to anybody. The decision of the Center Head/Director will be final & binding on the students and the parents.
That BSMH and you (the user) hereinafter referred as “Parties” agree that the present agreement shall be construed in accordance with the laws in force in India and in the eventuality of any dispute or difference (including in the eventuality of violation of the present agreement by any party) arise on any matter relating to or arising out of the present agreement the same shall be referred to the Sole Arbitration of an arbitrator to be appointed by the Director of Bombay School of Makeup whose decision shall be final and binding upon the parties. The sole Arbitrator shall conduct the arbitration proceedings at Mumbai only. It is also mutually agreed between the parties that the Parties would be entitled to invoke the present arbitration Clause/agreement during or even after the subsistence and even after the present agreement has expired or been terminated etc.
That in the event of such an Arbitrator to whom the matter has been originally referred is unable/failing/refusing to act for any reason whatsoever and/or withdrawing from his office at any stage/time, Director of Bombay School of Makeup shall be entitled to appoint another person to act as the Sole arbitrator. That such arbitrator shall be entitled to proceed with the reference from the stage at which it was left by his predecessor. It is also agreed between the parties that arbitration proceeding would be conducted in English only and in no other language.
That the Courts at Mumbai shall have exclusive jurisdiction (subject to the arbitration proceedings which are to be also conducted at Mumbai) over any or all disputes arising out of this present agreement and the parties hereby submit themselves to the jurisdiction of such Courts and/or Tribunals.
BSMH may also contact the user through email, call, whatsapp and/or SMS to give notifications on various important updates. Therefore, User holds BSMH non liable to any liabilities including financial penalties, damages, expenses in case the user's mobile number is registered with Do Not Disturb (DND) database.
Our Warranties and Disclaimers
We provide our Services using a commercially reasonable level of skill and care and we hope that it will benefit you using them. But there are certain things that we don’t promise about our Services.
Other than as expressly set out in these terms or additional terms BSMH does not make any specific promises about the Services. The specific functions of the Services, or their reliability, availability, or ability to meet your needs. We provide the Services “as is”.
Some jurisdictions provide for certain warranties, like the implied warranty of merchantability, fitness for a particular purpose and non-infringement. To the extent permitted by law, we exclude all warranties.
Liability for our Services
When permitted by law, BSMH will not be responsible for lost profits, revenues, or data, financial losses or indirect, special, consequential, exemplary, or punitive damages including but not limited to emotional loss, career loss, stress etc.
To the extent permitted by law, the total liability of BSMH for any claims under these terms, including for any implied warranties, is limited to the amount you paid us to use the Services (or, if we choose, to supplying you the Services again).
In all cases, BSMH will not be liable for any loss or damage that is not reasonably foreseeable.
We recognize that in some countries, you might have legal rights as a consumer. If you are using the Services for a personal purpose, then nothing in these terms or any additional terms limits any consumer legal rights which may not be waived by contract.
It is mandated that, parents and students will be required to submit the completed physical form as well on visiting the centre.
Security Deposit applicable as per the course selected will have to paid after the completion of online admission process. The same can be paid online or at the branch.
Business uses of our Services
If you are using our Services on behalf of a business, that business accepts these terms. It will hold harmless and indemnify BSMH from any claim, suit or action arising from or related to the use of the Services or violation of these terms, including any liability or expense arising from claims, losses, damages, suits, judgments, litigation costs and attorneys’ fees.

REFUND POLICY FOR CLASSROOM COURSES

BSMH Course Fee Refund: No refund of any course Fee shall be made under any circumstances whatsoever.
Registration Fee Refund: No refund of Registration Fee shall be made under any circumstances whatsoever.
Short Term Course Fee Refund: No fee refund of any type will be made under any circumstances after joining the Short Term Classroom Courses.
Refund Before Start of Course: If any student pays the fee for any course other than Short Term Classroom Courses and wants to withdraw/ask for refund before the commencement of classes/course in the school, the Registration / Admission Fee, Tuition Fee, Examination Fee and the first installment of Tuition Fee paid will not be refunded along with PDCs submitted, if any.
Refund After Start of Course: If any student of any course, including Short Term Classroom Courses, leaves the classes / institute from the date of commencement of the classes/course in the school / Academy due to whatsoever reason, the entire tuition fee, technology fee and examination fee paid will be forfeited and not subject to any refund along with PDCs submitted, if any.

Transfer Policy for Pro Make-up & Hair Course Students

A student after joining BSMH can shift to any other centre of BSMH throughout India provided his/her parents have either been transferred or have changed their residential address. Proper proof for the same is to be submitted by the student at the new centre where he/she wants to join. However, no intra-city transfer will be allowed under any circumstances.
The student will also submit proper details of fee paid at the first centre duly certified from the Incharge of that centre to the new Centre Incharge where transfer is required. Whatever amount of fee or its installments, a student might have paid at first centre, the rest of the fee installments left as per the details given in the prospectus of the new centre shall be paid at the new centre where transfer is required.
If any student has paid fee in lump sum or in installments and applies for transfer to a centre having higher fee than currently studying centre, then he/she shall have to pay the difference in fee between two centres whereas if a student after paying fee in lump sum applies for transfer to some other centre with lower fee than currently studying centre, he/she will not be refunded/paid the difference in amount of fee between the two centres.
If any student applies for transfer to any other branch / centre, he / she shall have to pay INR 5000/- towards transfer fee at the time of submission of application. Normally, the transfer process is completed within a week’s time.
If any student applies for transfer on the due date of fee installment or three days prior to that, then he/she will have to make the payment at the branch where he/she is currently studying, after which the transfer request will be considered.

Student Certification

The Course completion or recognition certificate shall be issued to the student only on satisfactory completion of course. Our Trainers have a right to deny certification to any student on the basis of the following points:

Attendance of the course below 90% of the scheduled class days
Late attendance or early leaving from class sessions
Misbehaviour with trainers, staff or fellow students of BSMH
Incompletion of assignments and maintenance of work journals pertaining to the respective courses
Non attendance of look test or portfolio shoots organised by the school for respective course batch on the specific dates
Unsatisfactory performance of look tests or portfolio shoots organised by the school
Damage to products or property of the school
Any other reason deemed fit by our trainers, staff and others.
Our trainers and BSMH Administrative staff has the sole discretionary rights to issue certification to any student.

Student Matters

If any Student fail to attend any sessions, BSMH is not bound to cover up the same and student will not have any right to hold BSMH responsible for any loss for any reason whatsoever.
In case the student fail to attend a part or in full of the entire course, BSMH is not liable to refund any part or full amount of fee paid by the student.
After seeking admission for a particular course the student cannot opt for another course and adjust the fee paid for the former against the latter. BSMH is not liable to adjust any fee paid for a particular course against the fee of other course wished to be opted by the other student.
Student may be required to hire models for their practice or their test shoot / portfolio shoot. BSMH shall not be responsible to arrange models for the students. BSMH is not liable to pay any amount to the model or student for any purpose thereof.
Student have to replace any product / consumables or objects / property any purpose thereof.damaged in course of his/her practice during the class sessions held. BSMH shall not be liable to provide products /valuables / cash / objects lost during the training session or otherwise. Any personal objects forgotten or kept by purpose in the school /academy premises shall be on sole responsibility of the student. Student shall not hold any student responsible for any loss of product
Admission to class is strictly at sole discretion of BSMH and its Office staff
